EHC needs assessment refused — what next?

A refusal to assess can be challenged. Read the local authority decision letter carefully because it should explain appeal and mediation information.

First actions

  1. Save the decision letter and note its date.
  2. Read the reasons given for refusal.
  3. Compare those reasons with the evidence you submitted.
  4. Check the mediation and SEND Tribunal information in the letter.

GOV.UK confirms that refusal to carry out an EHC assessment is appealable to the SEND Tribunal. In most cases you must contact a mediation adviser before appealing.
